"The Watchers Have No Watchers"

While the bombs were falling and the deals were closing, somebody had to make sure nobody was watching.

They made sure.

The Foreign Intelligence Surveillance Act. FISA was supposed to be the government's tool for watching foreign enemies. That was the sales pitch anyway. What it became, quietly and deliberately, is something else entirely: a domestic surveillance infrastructure with a foreign label on the box.

Section 702 was set to expire April 30. That is the same day as the War Powers deadline — and I might add the same day the UAE exits OPEC. You start to notice when everything expires at once. The FBI ran "warrantless" searches on more than 7,000 Americans in 2025. That's a 34% increase from the prior year. Searches targeting political organizations, religious groups, and media figures jumped from 227 to 839. View Dashboard → That's not a rounding error. That's a surveillance apparatus pointed inward — at the people whose job it is to ask questions.

The FISA court that operates in secret, hearing only one side, denied exactly 4 applications out of 287. Four. Yes, F-O-U-R. The court designed to check the watchers approved 98.6% of what it was asked to approve. That's not a court. That's a rubber stamp with a robe on it.

Senator Ron Wyden — the longest-serving member of the Senate Intelligence Committee — told TIME magazine that members of Congress are now seeing that "Donald Trump unchecked on FISA is a real threat to America." A sitting intelligence senator used the word unchecked. Write that down. Nobody was or is watching.

Meanwhile Trump reversed himself completely — as he always does. The man who spent years claiming FISA was used to spy on his 2016 presidential campaign, who had every reason to want it gutted, now suddenly wants a clean five-year extension. No reforms. No warrants. No questions.

Ask yourself why.

The answer isn't complicated. The apparatus that surveilled his enemies during the campaign is now pointed at his enemies. The machine didn't change. Just the operator did.

Here is what this means for everything else we've been documenting:

You cannot challenge a war authorization if you know your communications are being searched without a warrant. You cannot organize opposition inside Congress if the FBI is running 839 searches a year on political targets and reporting to an Attorney General who answers to one man. You cannot whistle-blow through channels that are themselves being watched.

The constitutional framework requires that the branches check each other. What FISA has become in this configuration — under this administration — is the mechanism that prevents the checking.

The guardrails were never load-bearing.

But somebody made sure you couldn't even reach them.
